This document outlines the Terms of Service for any person or persons who purchase a service from Waterfall (https://waterfall.gg). 'We', 'us', 'our', and 'Waterfall' refer to Waterfall as a company. 'You', 'your', 'Our Services' refer to any or all of our website at waterfall.gg, its subdomains, associated domains, and our associated hosting services. 'You', 'customer', and 'the user' refer to the client purchasing services.

These Terms of Service, along with our Privacy Policy and Acceptable Use Policy, collectively form the legal framework governing the agreements between Waterfall and its Customers. These terms are governed by and should be interpreted in accordance with the laws of the United Kingdom. We reserve the right to change these terms of service at any time, at our discretion, without notice.

If you encounter any issues with your Waterfall account or our services, please contact us so we can address them in a timely manner.

Billing, Payment, Cancellation, and Refunds

Account Creation and Billing: New customers can create their Waterfall account on our website during the purchase of our services. Once a service is purchased, an invoice is generated immediately based on the chosen billing cycle. The service(s) will be provisioned only after the invoice is paid in full.

Non-Payment Consequences: If your invoice is unpaid, your relevant service is at risk of being terminated, with no notice, at our discretion. If a service is terminated due to non-payment of an invoice or any other reason, all data associated with that service will be automatically deleted from our systems and cannot be recovered. However, your account will remain in our systems.

Refund Policy: Waterfall provides a 12-hour, no-questions-asked refund policy for Game Hosting services, known as our "Money-Back Guarantee." However, Managed and Dedicated Server offerings are non-refundable. We reserve the right to deny a refund request if we suspect fraudulent activity, at our discretion, and we will only issue one refund per customer. Refunds will not be granted after the 12-hour period unless it is part of a promotional offer. To request a refund, please contact us at sales@waterfall.gg promptly.

Disputes and Chargebacks: If you initiate a dispute or chargeback through any payment gateway, your account and any associated services will be immediately terminated. Additionally, you will be permanently banned from using our services in the future.

Service Cancellation: To cancel one or more of our services, customers must use the Request Cancellation option within our billing panel. The available cancellation options are:

  1. Immediate Cancellation: The selected service will be terminated within 24 hours of receiving the cancellation request. No refunds will be provided for any remaining billing period.
  2. Cancellation on Next Due Date: The selected service will be terminated on the next invoice due date.

In both scenarios, all data associated with the relevant service will be automatically deleted on the relevant date, with no option for recovery. Customers are responsible for saving any data they wish to retain to a secure location outside their server before the service termination date.

Digital Content Purchases: We partner with Tebex Limited (www.tebex.io), who are the official merchant of digital content produced by us. If you wish to purchase licenses to use digital content we produce, you must do so through Tebex as our licensed reseller and merchant of record. In order to make any such purchase from Tebex, you must agree to their terms, available at https://checkout.tebex.io/terms. If you have any queries about a purchase made through Tebex, including but not limited to refund requests, technical issues or billing enquiries, you should contact Tebex support at https://www.tebex.io/contact/checkout in the first instance.

Acceptable Use Policy

Unacceptable Uses: You may only use our services for lawful purposes. The following activities are strictly prohibited:

Respect for Systems: You acknowledge and respect not to access, interfere with, damage, or disrupt any equipment or network on which our services depend or operate, any software used in the operation of our services, or any equipment, network, or software owned or used by any third party without authority.

Suspension and Termination: We will determine, at our sole discretion, whether there has been a breach of this Acceptable Use Policy through your use of our services. If a breach has occurred, we may take any action we deem appropriate, including warning, removal of content, service withdrawal, legal proceedings, and disclosure to law enforcement authorities.

Changes to Terms

We may revise this Acceptable Use Policy and/or the Terms of Service at any time and at our sole discretion, without notice. Certain terms in this Acceptable Use Policy and/or the Terms of Service may be overridden by updates to the other policies mentioned above, as published on our website.
